Recent changes have been made to the upcoming Safety-Qualified Underground Telecommunications Installation rules.

Starting in 2026, Minnesota state law (Minnesota Statutes 326B.198) will require that certain tasks related to the installation of underground telecommunications infrastructure be performed by Safety-Qualified Underground Telecommunications Installers. To qualify, an underground installer must complete and maintain required certifications by taking an approved 40-hour course that involves both classroom and hands-on training. Standards for these courses will be approved by the Minnesota Department of Labor and Industry (DLI), in consultation with the Office of Broadband Development.

When does this certification requirement go into effect?

Beginning January 1, 2026, the installation of underground telecommunications infrastructure throughout Minnesota is subject to MN Statutes 326B.198. From that date, certain tasks related to the installation of underground telecommunications infrastructure must be performed by safety-qualified underground telecommunications installers.

When must work be performed by a safety-qualified underground telecommunications installer?

The new requirements apply to underground telecommunications infrastructure that is being installed within 10 feet of existing underground facilities or crosses existing underground facilities. When this requirement is met, a safety-qualified underground telecommunications installer must perform the location of existing utilities starting on January 1, 2026. Similarly, if the installation of telecommunications infrastructure is to be made by means of directional drilling, a safety-qualified underground telecommunications installer must monitor the location and depth of the drill head.

The installation of underground telecommunications infrastructure that is NOT being installed within 10 feet of existing underground facilities or crossing existing underground facilities does not require the on-site worker to be certified.

What are the training requirements for this certification?

To become certified as a safety-qualified underground telecommunications installer, individuals must complete 40 hours of training and pass an exam. This involves both classroom and hands-on instruction. Click here to view a draft course outline and curriculum.

The legislation also requires that certified installers obtain four hours of refresher training, to be completed within three years of completing the initial course – and every three years after – to maintain certification.

Who can provide the safety-qualified underground telecommunications installer training?
